Eles chamam de “reestruturação de carteira”. A Justiça chama de abuso. Saiba por que o aviso de 30 dias não é uma sentença final.
Imagine chegar em casa depois de um dia longo, abrir a caixa de correio e encontrar uma carta simples, fria e direta da sua operadora de saúde. O texto é curto: “Informamos que seu contrato será encerrado em 30 dias. Agradecemos a parceria.”
Sem justificativa clara. Sem negociação. Sem opção de ficar.
Para milhares de famílias brasileiras — especialmente aquelas com contratos Coletivos por Adesão ou MEI — essa cena deixou de ser um pesadelo distante e virou realidade. É o fenômeno da “Limpeza de Carteira”.
As operadoras, em uma busca desenfreada por lucros maiores, decidiram que alguns clientes simplesmente “não valem a pena”. E quem são esses clientes? Justamente aqueles que usam o plano: pacientes oncológicos, crianças autistas em terapias contínuas, idosos com doenças crônicas. Aqueles que não interessam ao plano pela utilização recorrente.
O cancelamento unilateral não é uma medida administrativa. É uma seleção de risco. É escolher quem vive e quem fica desassistido baseando-se em uma planilha de Excel.
A Mentira dos “30 Dias”
A operadora tenta te convencer de que, por ser um contrato coletivo (aquele vinculado a uma associação, sindicato ou CNPJ), ela tem o direito de rescindir quando quiser, desde que avise com antecedência.
Eles usam cláusulas contratuais leoninas para dizer: “Está no contrato, nós podemos cancelar”.
Mas aqui entra a verdade que eles não querem que você saiba: o Direito à Vida e à Saúde se sobrepõe a qualquer cláusula contratual. O contrato não é um cheque em branco para o abandono.
O Escudo do Paciente em Tratamento
A jurisprudência brasileira, consolidada pelo Superior Tribunal de Justiça (STJ), criou uma barreira intransponível para as operadoras: é proibido cancelar o plano de saúde de beneficiário que esteja em tratamento médico garantidor da sobrevivência ou da incolumidade física.
Se você ou seu dependente está no meio de uma quimioterapia, de um ciclo de terapias para autismo, de uma internação domiciliar (Home Care) ou de qualquer tratamento contínuo indispensável, o plano NÃO pode ser cancelado.
A rescisão, nesse cenário, é considerada abusiva, ilegal e desumana. A operadora é obrigada a manter o contrato ativo, nas mesmas condições, enquanto perdurar a necessidade do tratamento.
“Mas eu não estou doente agora, e meu plano foi cancelado. E aí?”
Mesmo para quem não está em tratamento grave, a briga não está perdida. A Justiça tem entendido cada vez mais que o “cancelamento em massa” sem oferecer uma alternativa viável de migração (portabilidade sem carência para plano similar e com preço compatível) fere o Código de Defesa do Consumidor.
Deixar o consumidor desamparado no mercado, obrigando-o a cumprir novas carências em outro lugar, é uma prática predatória.
Recebeu a Carta? Não entre em pânico, entre em ação.
O aviso de cancelamento tem um objetivo psicológico: fazer você aceitar o fim e correr desesperado para contratar um plano novo (provavelmente mais caro e com menos cobertura). Não caia nessa armadilha.
1. Não assine nada concordando com o cancelamento.
2. Reúna laudos médicos que comprovem a necessidade de continuidade de qualquer tratamento em andamento.
3. Busque o socorro jurídico imediato. Uma liminar pode suspender esse cancelamento em questão de dias, garantindo que o plano continue ativo e que os tratamentos não sejam interrompidos nem por um minuto.
A “Carta Bomba” só explode se você permitir. Com a estratégia certa, ela se torna apenas mais uma prova da conduta abusiva da operadora, e o seu direito de permanecer protegido prevalece.
